Terms & Conditions

Introduction

These Terms & Conditions (“Terms”) govern your use of Auctiqs (the “Platform”). Auctiqs provides fast online auctions (typically 12–24 hours) and acts as an intermediary between sellers and buyers. By using the Platform, you agree to these Terms.

Definitions

  • “Seller” – a user who lists an item for auction.
  • “Buyer” – a user who places bids and may win an auction.
  • “Bid” – a binding offer to purchase at the stated amount.
  • “Auction” – a listing with a defined start and end time.

Eligibility & Account

By using the Platform you confirm that you are at least 18 years old and able to enter into a binding agreement. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

Listings & Content

Sellers are responsible for the accuracy of item descriptions, images, and listing details. Users may submit content in their own language; Auctiqs may automatically translate content for EU audiences. Translations are provided “as is” and may contain inaccuracies.

Auctiqs is not responsible for errors or omissions in translated content. Where available, the original listing text is shown on the item details page and should be treated as the authoritative source.

Sellers confirm that they own or have the rights to all content (text, images, trademarks) used in listings. Auctiqs may remove content that violates intellectual property rights or these Terms.

Bidding Rules

  • All bids are binding offers to purchase.
  • The highest valid bid at auction end wins the auction (subject to any reserve conditions, if applicable).
  • Self‑bidding and manipulation are prohibited.
  • Sellers may create multiple auctions for a product, but only one auction can be active at a time.
  • Auctions must be scheduled at least one (1) day in advance.

Fees & Charges

We charge a transaction fee of 3% + 22% VAT applied to the 3% fee. The fee is calculated on the final sold price plus shipping price. Example: if the fee is 3 EUR, 22% VAT is added to that fee. Auctiqs may reduce fees for specific sellers at its sole discretion. Payment provider fees (e.g., PayPal) are deducted from the payout to the seller. Auctiqs may increase or decrease fees for all sellers without prior notice. Any change applies only to newly created auctions from the time of the change.

Payments & Escrow

Payments are handled through approved payment providers. Auctiqs may hold buyer funds in escrow until delivery is confirmed, for a maximum of 30 days. After confirmation (or at the end of the escrow period), funds are released to the seller. Sellers must connect a valid PayPal account (or another approved payment method) to receive payouts.

Auctiqs never holds buyer funds in its own bank account. Escrow is provided via PayPal and all funds flow through PayPal. Once a purchase is successfully completed, Auctiqs automatically deducts its fee and the remaining amount is paid out to the seller, all via PayPal.

All payments must be made exclusively on auctiqs.com. Auctiqs never sends payment links by email or SMS. Payments are processed only via PayPal.

Selling is not possible without a connected PayPal account, because payouts cannot be completed otherwise. Auctiqs has no rights to access or control the seller’s PayPal account; it can only facilitate the transfer of funds to the seller through PayPal.

Shipping (EU only)

The Platform is intended for EU‑only auctions and shipping. Buyers must provide a valid EU shipping address. We may share the buyer’s shipping address with the seller to complete delivery.

Items may only be sold from within the European Union. Buyers should not incur customs charges. If a buyer reports customs costs, Auctiqs may require reasonable proof and may refund the full purchase price at its discretion, regardless of whether the package was accepted or delivered. Listing or shipping items from outside the EU may be treated as a violation of these Terms.

Returns & Disputes

Return rights may depend on the specific listing and applicable law. Disputes should be raised through the Platform support. Auctiqs may assist as an intermediary but is not the seller of listed items.

If the buyer has not received the item by day 27 after payment, the buyer must report the issue. Otherwise, payment will be released to the seller on day 30. After delivery, the buyer must open a dispute within three (3) days of receipt; otherwise payment will be released to the seller after the three‑day period.

Auctiqs acts as a facilitator and may assist with disputes but does not act as an arbitrator or guarantor of outcomes.

Prohibited Items & Conduct

Users must not list prohibited items, illegal goods, or engage in fraud, harassment, or manipulation. We may remove listings or suspend accounts for violations.

Automated scraping, data harvesting, or the use of bots or scripts to access the Platform is prohibited unless explicitly authorized by Auctiqs.

Buyers may contact sellers only through the Auctiqs messaging system. Any attempt to complete a sale outside of Auctiqs for items listed on the Platform is a violation of these Terms and may result in account suspension or permanent blocking.

Sharing contact details or directing users to complete transactions off‑platform is prohibited. Auctiqs may immediately suspend accounts and, where permitted by law, hold or delay payouts while investigating suspected circumvention.

Weapons and any items connected to criminal activity are strictly prohibited. Auctiqs does not accept liability if such items appear on the Platform. We will attempt to remove prohibited items and block related users as quickly as possible, but removal may not be immediate.

If a seller fails to ship a successfully sold item, Auctiqs may suspend or block the seller’s account. If a buyer wins an auction but does not pay within five (5) days, Auctiqs may restrict or disable the buyer’s access to the Platform.

If the winning buyer fails to pay within five (5) days and there is another bidder, the next highest bidder is automatically treated as the winner at their bid price, and the seller may proceed with that sale.

Liability & Disclaimer

Auctiqs acts as an intermediary between buyers and sellers. We do not own listed items and do not guarantee the quality, legality, or delivery of items. To the fullest extent permitted by law, Auctiqs is not liable for disputes, damages, or losses arising from transactions between users. Buyers must resolve product issues directly with sellers; Auctiqs may provide assistance but does not accept liability for purchased items.

Items are sold “as‑is” and any warranties are solely the responsibility of the seller, except where mandatory law provides otherwise. Auctiqs does not provide any warranties for listed items.

Auctiqs is not liable for service interruptions, technical issues, or delays caused by force majeure (including but not limited to outages, network failures, or events beyond reasonable control).

Chargebacks & Payment Reversals

Unauthorized or abusive chargebacks may result in account suspension or termination. Auctiqs may recover related costs, fees, and losses from the responsible party where permitted by law.

Taxes

Sellers are responsible for determining and paying any applicable taxes, duties, or fees related to their sales.

Auctiqs may provide relevant sales and transaction data to tax authorities or other competent public bodies when required by law.

Service Changes

Auctiqs may modify, suspend, or discontinue parts of the Platform at any time. We are not liable for any resulting loss or inconvenience.

Suspension & Termination

We may suspend or terminate accounts for violations of these Terms or legal requirements, or to protect the Platform and users.

No Partnership

Nothing in these Terms creates a partnership, employment, or agency relationship between users and Auctiqs.

Platform Time & Records

The Platform’s time and logs are the authoritative record for auction start/end times, bids, and system events. You agree that Auctiqs logs may be used to resolve disputes.

Electronic Communications

You agree to receive communications electronically (e.g., email, in‑platform messages) and that such communications satisfy any legal notice requirements.

Governing Law

These Terms are governed by the laws of Slovenia, without regard to conflict‑of‑law principles.

Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

Assignment

Auctiqs may assign or transfer its rights and obligations under these Terms to a third party. You may not assign your rights without written consent.

Privacy

Processing of personal data is described in our Privacy Policy.

Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date.
